Ministry of Ports, Shipping and Waterways has circulated draft of Indian Ports Bill 2020 for public consultation which will repeal and replace the Indian Ports Act, 1908 (Act No. 15 of 1908)

The draft Indian Ports Bill, 2020, seeks to,inter alia, enable the structured growth and sustainable development of ports to attract investments in the Port sector for optimum utilisation of the Indian Coastline by effective administration and management of ports. The proposed Bill will provide measures to facilitate conservation of ports, taking into account the prevalent situation with respect to the high number of non-operational ports. It shall further ensure greater investment in the Indian maritime and ports sector through the creation of improved, comprehensive regulatory frameworks for the creation of new ports and management of existing ports.

The Bill also seeks to, inter alia, create an enabling environment for the growth and sustained development of the ports sector in India through the following broad methods:

1.Constitution of Maritime Port Regulatory Authority
2.Formulation of the National Port policy and National Port plan in consultation with Coastal State Governments, State Maritime Boards and other stakeholders.
3.Formulation of specialised Adjudicatory Tribunals namely Maritime Ports Tribunal and Maritime Ports Appellate Tribunal to curb any anti-competitive practises in the port sector and act as a speedy and affordable grievance redressal mechanism.

The up-to-date provisions of the proposed Bill would ensure safety, security, pollution control, performance standards and sustainability of Ports. The Bill ensures that all up-to-date conventions/protocols to which India is a party, are also suitably incorporated. This will promote marine safety and security in the true sense. The Bill will fill up the gapsfor achieving scientific development of Ports and Port Network.

The Bill seeks to provide increased opportunities for public and private investments in the Indian maritime and ports sector by way of removing barriers to entry, simplifying processes and establishment of agencies and bodies to plan and enable growth of the ports sector. Enhancing “Ease of Doing Business’,it will provide greater impetus to a self-reliant domestic investment climate in the maritime sector, towards AatmaNirbharBharat initiatives of the Government.

The draft of Indian Ports Bill 2020 is issued for public consultation for seeking the feedback and suggestions.

बंदरगाहों और समुद्री मार्ग को बढावा देना यक़ीनन देश हित में है समुद्री यातायात शुरू किया जाए तो हमारे देश में पर्यावरण संरक्षण मे बड़ा योगदान होगा लेकिन नियामक प्राधिकरण और अपीलीय न्यायनिर्णयन अधिकरण की ज़रूरत नही। हमारे देश की सबसे बड़ी कंपनी BSNL को, क्या ट्राई (TRAI) नियामक बचा पाया? दो साल के इन्तेज़ार बाद टेलिफोन मिलने का जो आनंद था वह BSNL को सरकार द्वारा दुर्लक्षित कर प्राइवेट कंपनियों को बढावा देना शर्म आती है, आज भी हम चाहे तो BSNL को देश की ही नही दुनिया की सब से बडी कंपनी बना सकते है।

निवेश किसी भी प्रकार का हो खतरे से खाली नहीं है और सरकारी क्षेत्र मे निवेश के क्या कहने, पता नही कब प्राइवेट क्षेत्र के हाथो मे दे दिया जाए भरोसा नही, फायदा तो दूर नुकसान का रोना रोए तो किस के पास I इंडियन पोर्ट क्षेत्र मे सुधार करने की ज़रूरत है बल्कि ऐसे मार्ग पर यातायात शुरू करने से पर्यटन उद्योग को बढ़ावा मिलेगा ज़रूरत है समुद्री मार्ग पर यातायात शुरू कर विस्तार करने की, इस मार्ग पर आधुनिक बोट, छोटे और बड़े जहाज़ शुरू करने की, यक़ीनन प्रतिसाद मिलेगा सिर्फ ईच्छा शक्ति की ज़रूरत है।

The Draft Indian Ports Bill 2020 is for the Regulatory control of the ports, not for its planning, development and progress. The IPB2020 is to ensure that the ports operate and develop without breaking the laws of the world, country, ports, and environment. Suggested change at the start of the draft bill is added..

Dear sir, भारतीय बंदरगाहों का विकास बहुत ही जरुरी है इससे हमारे देश का विकास आगे बढ़ेगा बंदरगाहों पर बदलाव लाना ये एक अच्छा कदम है इससे आयात निर्यात को अंतरराष्ट्रीय स्तर पर बढ़ावा मिलेगा बंदरगाहों के विकास से वहां रह रहे मछुआरों का भी विकास होगा जिनकी रोजी रोटी ही बंदरगाहों से चलती है हमारे मछुआरे भाइयों को रोजगार मिलेगा अभी तक वहां पुराने तौर-तरीके थे अब उनके साथ मिलकर नये रुल नियम बनाए जाने चाहिए जिससे हमारे देश का और हमारे मछुआरे भाइयों का भी विकास होगा

पोर्ट विल मे स्थानीय जल यातायात को बढ़ाने के लिए नियम अवश्य बनाए जाए।

Port shall be connected to Outer Ring Road through Bridges / flyover. So that idling time of road transport vehicle will be reduced. it will save lot of time & money. Idling charges will not be imposed on goods by logistics company.

The Indian Port Bill 2020 as drafted is excellent. I have 40 years of marine experience with 18 years as Port Officer in Maharashtra. And have designed Vijaydurg as Biggest Port in the world with 1 phase of ultimate harbor of about 40 ships and Port Redi as a Port with Cargo Capacity equivalent to all major ports taken together. I strongly feel that port sector is still not properly discovered. I am sending my suggestion on some amendments to strengthen this bill.

Indian Ports Bill 2020 has covered almost all points briefly from all points of view. They must be strictly implemented and suggestions must be taken from the people directly or indirectly involved with the Ports activities, staff, non-staff, merchants, Ship drivers etc. Transparency, safety, security, powers, functions are clearly mentioned. Even common man can clearly understand the Indian Ports Bill, 2020.
