Ministry of Power has identified few key amendments in the Electricity Act 2003 to address immediate requirements of the electricity sector. Accordingly, draft proposal has been circulated on 17.04.2020 in the form of draft Electricity Act (Amendment) Bill 2020 and stakeholders comments sought till 5th June 2020.

1. Establishment of Electricity Contract Enforcement Authority under retired Judge of the High Court for ensuring performance of the contract. The Authority shall have all the powers of a civil court including but limited to powers of attachment and sale of property, arrest and detention in prison and appointment of a receiver. This will ensure faster disposal of adjudicating matters regarding performance of obligations under a contract related to sale, purchase or transmission of electricity.

2. Determination of Cost reflective Tariff for ensuring viability of Electricity Distribution companies (Discoms). the Appropriate Commission to fix tariff for retail sale of electricity without accounting for subsidy; The subsidy, as declared and provided by the State Governments, will be given directly by the government to the consumers clearly reflecting in their bill;

3. Distribution sub licensees: Distribution Licensee may authorise another person, as a sub-license to supply electricity in any particular part of its area of supply, with the permission of the State Electricity Regulatory Commission. This will enable the sub licensee to serve the consumers with full responsibility and due diligence. The distribution licensee will now have the choice to opt for either sub-licensee model or franchisee model. This proposal will bring investment in the distribution sector, ensure regulatory oversight and protect the interests of consumers.

4. Establishment of adequate Payment Security Mechanism : Proposed to empower Load Dispatch Centres to oversee the establishment of adequate payment security mechanism before scheduling dispatch of electricity, as per contracts.

5. Strengthening of the Appellate Tribunal (APTEL): It is proposed to increase its strength of Members, apart from the Chairperson, to at least seven to facilitate quick disposal of cases; also to enhance the powers by assigning power equivalent to High Court under the provisions of the Contempt of Courts Act. With increased strength of members, now APTEL benches can also sit in a place other than Delhi as per the requirement of the case and for easy access to the state.

6. Proposal for Single Selection Committee for giving recommendations for appointments of chairperson and members in central as well as state regulatory commissions for uniformity in selection. The Selection Committee shall be headed by the Judge of Supreme Court .Appointments shall continue to be done by respective Governments.

7. National Renewable Energy Policy: It is proposed to have a separate policy for the development and promotion of generation of electricity from renewable sources of energy.

8. Hydro Power Purchase Obligations (HPO): a minimum percentage of purchase of electricity from hydro sources of energy is to be specified by the State Commissions. Hydro Power purchase Obligations shall be separate part of non solar based Renewable Purchase Obligations.

9. Enforcement of Renewable purchase obligations by levy penalties for non-fulfilment of obligation to buy electricity from renewable and/or hydro sources of energy.

10. Provisions related to Cross border trade in Electricity have been added to facilitate and develop trade in electricity with other countries.

The slab system in power tariff should be rectified. Higher charges should be on the additional consumption and not on the whole just like income taxes are on the additional incomes. DBT of subsidies is better than the free power concept. In the free power concept often the farmers end up getting no power at all. Also DBT makes one feel one really got something as a gift rather than one took something as a right.

There should mandatory clauses stating that the power distribution companies should carry out substantial degree of research. A percentage of their business amount should be spent on appropriate research in house or at universities or labs. Power companies should not be merely agents doing paper work, and billing and profit making or real estate activities.

ओम्, माननीय मोदी जी,
हम सभी भारतवासियों को ईमानदार होना चाहिए,बिजली डिपार्टमेंट में कार्य करने वाले को बिजली के बिल देना चाहिए,वैसे ही डिपार्मेंट के लोग बिजली कि बहुत ही खपत करते है जो कि बेवजह होता है,बिजली की चोरी भी बहुत होती है,आम जनता भी बहुत ऐसे अनुचित कार्य करती है,
सब से पहले सभी को ईमानदार होने की आवश्यकता है,देश के सब सरकार के साथ बेईमानी नहीं करनी चाहिए।
घरों में भी सभी नागरिकों को चाहिए की बिना मतलब के बिजली का उपयोग नहीं होना चाहिए,समझदारी के साथ बिजली का उपयोग होना चाहिए।

There should be some scope spelt out clearly for power distributions to be made underground. Or there should be some scope at least to ensure that the electromagnetic waves do not cause damage to life.

1. At first all uncovered wair should be cable in locality area.
2. For BPL families arrange solar or free electric bill limit should be 100 units/m.Because some people help to thief electric.As a result electric distribution company losing profit.
3. Electric bill in Rural and urban should be ₹3.50/unit for 300units/ 3months.Comercial bill should be ₹5/unit for 300units/3 months.
4. For send fack bill/wrong bill need a tough rules and penalty(1lakh/unit) for electric distribution company

Pl. make young, dynamic, technically qualified, fearless fresh minds who are up to date in their knowledge on the subject, and for whom their and their country’s future is at stake, the absolute decision makers in all the teams proposed. It is harmful to make them subservient and is counterproductive. It likely to ill serve the common good.

It is a pity that the supreme court or other judges of various categories are pulled everywhere even when matters are substantially technical and commercial. To put chief secretaries and others who are always busy is also a waste. Also judges who take decades to comprehend and solve even obvious issues are once again chosen to head matters here too. Here time is the essence. So pl. remove all such office bearers from the various committees from this proposal.

I see no mention of any roof top power generation, two way meters, micro producers and their roles or any such crucial matters regarding solar power related infrastructure. It is a pity.

Solar ,solar and solar is the only mantra which can save all and benefit all. Any amendment which is not explicitly forthcoming in this regard is largely a futile one as far as people are concerned and likely to be of little value and will have to be replaced even before it begins to produce any results.

Most of the citizens are not lawers. Before putting out to the public the clauses and their intended efffects should be stated. then we can really give the feed back in the best way. Pl. state will the amendment ensure uninterrupted power supply to those connected ? Will it enable easy hassle free new connections and disconnections?Will it reduce middle men?Will it increase solar power.? Will it reduce cost or at least keep nearly same? If not it is useless and could be harmful.
