The Telecom Regulatory Authority of India (TRAI) has been mandated by the TRAI Act, 1997 to regulate the tariffs offered by the Telecom Service Providers for its various services. Despite the amendments made to the TTO and other regulations issued by TRAI to factor in various market developments, a need has been felt to undertake a comprehensive review of the TTO framework, albeit in a phased manner, starting with a discussion on the core regulatory principles enshrined in the TTO, Directions and Advisories issued by TRAI on various aspects of the tariff framework from time to time.

In order to identify and address the various emergent issues and challenges, inter-alia, related to regulatory principles of tariff assessment e.g. transparency, promotional offers, disclosures and non discrimination, adherence to the principle of non-predatory pricing, meaning of predatory pricing, relevant market, assessment of dominant position etc., Telecom Regulatory Authority of India (TRAI) has released Consultation Paper on ‘Regulatory Principles of Tariff Assessment’ on 17th February, 2017 to solicit comments from the stakeholders.

The objective of this Consultation Paper (CP) is to bring about greater clarity in interpretation of various regulatory principles set out in the TTO in consonance with the best global practices.

Click here to read the consultation paper. The written comments on the issues raised in the consultation paper are invited from the stakeholders by 17th March, 2017.

The #TRAI has a fundamental role of "regulation" of tariff. In the Consultation Paper, #CP, one of the main aspects discussed is the influence of the Competition Act on "predatory pricing". My suggestion is to define the scope of #TRAI, #DoT in relation to pricing, when significant market changes involving 2 or more Significant Market Powers(SMP) occur. CCI (Competition Commission of India) should be involved on case-to-case basis.

In this digital era,all operating companies competed hardly and this is healthy for consumers because they have many alternative,I think existing norms are good but something is lacking.there is need of minimum 1mbps data speed after ending of data limit.government decide minimum speed 500kbps but relicense jio giving only 128kbps after crossing data limit.no need of changing net neutrality rules.free promotions are also good for healthy competition as well as for consumers.

Contd.
Going public at pre structuring stage/ restructuring stage instead of engaging experts at national and International level and testing on best International practice seems, that [CP] are not give due justice and will go as a routine exercise or like polishing shoes which are subjected to dirt, mud...etc in everyday life. We must constitute body of national and international experts and TUNE [CP] with national objective before body interpret and prepare mold for stake holders feedback.

As mentioned, objective of this Consultation Paper(CP)is to bring about greater clarity in interpretation of various regulatory principles set out in the TTO in consonance with the best global practices. We believe just greater clarity for interpretation will not serve any purpose, until principles[cp]are fully decoded and finally defined and set on self developing mechanism. Periodic re-interpretation and cosmetic interpretation to suit our likes n dislikes in itself is a destructive activity.
